These “Payment Terms” apply to our commercial transactions with you, including your purchase of any Paid Service from us (as those terms are defined below). We refer to any service for which we charge a fee as a “Paid Service.” You should carefully read through these Payment Terms to understand your rights and responsibilities, as these Payment Terms constitute a contract between you and PicWish Corporation or its affiliate from which you are purchasing the Paid Service (we refer to these collectively as a “Commercial Transaction”). By purchasing a Paid Service, you agree to be legally bound by these Payment Terms. (Please see our explanation of who you are contracting with in different circumstances in the section below entitled “Who Am I Contracting With?”.) If you do not agree to the Payment Terms, then you can decide not to complete a Commercial Transaction.

You agree to receive electronically all communications, agreements and notices that we provide in connection with any PicWish product or service (“Communications”), including by e-mail, text, in-app notifications, or by posting them on the PicWish website or through any PicWish service or product. You agree that all Communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

We may update these Payment Terms from time to time. Please be sure to review these Payment Terms before you finalize any Commercial Transaction.

Payment of Fees; Taxes

When you elect to purchase a Paid Service from us or any third-party reseller and enter a form of payment, you agree that: (i) you will fulfill your obligation to pay for the Paid Service by the date on which payment is due; (ii) any payment information you provide is true and accurate; (iii) you are authorized to use the payment method you provide; (iv) we have permission to retain the payment information and method, including all submitted debit and credit card information, submitted by you and your issuing bank or the applicable payment network; and (v) we or our reseller (as applicable) are authorized to charge you for the Paid Service using the established payment method and the information you provide that is stored in your account as of the applicable date for payment. Your assurances of payment and our rights to collect payment include any obligation you may have to pay any taxes or delivery charges described as applying to the Product you are buying. In addition, you agree that you will be responsible for any credit card chargeback fees as well as any reasonable collection costs we incur as a result of your failure to pay on a timely basis.
You agree to pay the charges for the Paid Service in the currency specified by PicWish (or any reseller or payment processor from which you may purchase the Paid Service) when you enter into the Commercial Transaction, and you assume all risks associated with any changing value in the currency compared with other currencies. The specified charges for a Paid Service are VAT-inclusive and may include certain other taxes or delivery or similar charges applicable to your purchase. If any tax or charge applicable to a purchase is not charged by us, you acknowledge that you are solely responsible for paying the tax or other such charge. The receipt provided to you reflecting your purchase includes VAT (if applicable) which is charged based on your location.
Our prices for a Paid Service do not include any of the third-party fees you incur in connection with using a Paid Service including, without limitation, fees charged by your Internet access provider, any wireless carrier charges for cellular or data services and any other third-party applications or services with which you may use the Paid Service; you are responsible for selecting and managing these other services, and paying the fees for such services.

Changes in Fees

We may change the price of any Paid Service from time to time, and add new fees and charges for certain features or to reflect a change in business or legal rules, but we will provide you with advance notice of changes in recurring subscription fees. Any increase in charges for the same Paid Service would not apply until the expiration of your then-current billing cycle, unless otherwise specifically provided in our notice to you, and would become effective no sooner than the next time you would be charged for that Paid Service. If you do not agree to pay the new price or other applicable charges, you may elect not to renew the Paid Service subscription before the price change goes into effect, which cancellation would be effective at the expiration of your then-current billing cycle. See “Cancellation” below for information on how to cancel a Paid Service subscription.

Pro Plan Service:

The pro plan for PicWish mobile currently offers three types of subscriptions: weekly, monthly, and yearly.

The pro plan for PicWish web currently offers three types of subscriptions: weekly, monthly, and yearly. PicWish pro plan service will be adjusted according to user needs, and may add new subscriptions, delete existing subscriptions or make other changes. If it involves upgrades or changes to the Pro plan, PicWish will inform you and ensure that it will not affect your full enjoyment of existing benefits.

For the cutout function, 1 credit will be consumed for each successful save.

For the white background function, 1 credit will be consumed for each successful save.

For the ID photo function, 1 credit will be consumed for each successful save.

For the enhancement function, 2 credits will be consumed for each successful save.

For the retouch function, 1 credit will be consumed for each successful save.

For the colorization function, 1 credit will be consumed for each successful save.

For the face cutout function, 2 credits will be consumed for each successful save.

For the image enlarger function, 2 credits will be consumed for each successful save.

For the AI Instant Background function, 6 credits will be consumed for 2 successful save. (The credits given by purchasing a membership will be used first.)

Using the above functions to process or generate images will consume credits. Credits will be calculated and deducted based on the number of images and the number of consumption of the function. For example: you used the cutout function to process 3 images and the sharpening function to process 4 images. A total of 11 credits are consumed.
Repeatedly saving an unreprocessed image will not result in repeated deduction of credits.

When using the credits service, you may not directly or indirectly upload, download, create, process, publish, store, disseminate or share any content that violates any legal policies, rules or infringes upon the legal rights of any third party.

Breach of Contract and Liability

During the use of this service, if you engage in the following behaviors, you will be deemed to have breached the contract:

  • Violation of the provisions of this Agreement;
  • Using this service to obtain illegal benefits;
  • Deemed by the relevant departments to infringe the legitimate rights and interests of any third party;
  • Any behavior that infringes the legitimate interests of PicWish, including but not limited to infringement of the intellectual property rights owned by PicWish.

You should abide by public order and shall not infringe on the reputation, privacy, intellectual property rights and other legitimate rights and interests of others.

In any case, once PicWish reasonably believes that you have committed the above-mentioned behaviors, for the necessity of maintaining network security and public order, it may, at any time and without prior notice, take one or more of the following measures to deal with it:

  • Use technical means to delete or block relevant information that leads to breach of contract;
  • Suspend or terminate part or all of the services.

If this service is suspended or terminated due to your breach of contract, PicWish does not need to refund any fees to you. You shall bear all losses in your account (including but not limited to the reduction or loss of user data, etc.), and you shall also compensate PicWish for any losses (including but not limited to attorney fees, litigation costs, etc.).

Suspension or Termination of this Agreement

This Agreement shall be suspended or terminated in the following circumstances:

  • You actively request it;
  • You have any violation of the provisions of the laws and regulations of your country, the provisions of this Agreement, and other acts that seriously affect the reputation and interests of PicWish;
  • Required by laws and regulations or competent authorities;
  • PicWish has urgent needs to maintain account and system security;
  • Force majeure (i.e. objective circumstances that cannot be foreseen, avoided or overcome, including national laws, regulations, policies, orders of national agencies and other government actions or other such as typhoons, floods, earthquakes, tsunamis, wars, strikes, etc.);
  • Other circumstances.

Changes to Payment Methods and Account Information

You are responsible for ensuring that your account information, including your email address and all payment information (address, debit or credit card number and expiration date), is accurate and up to date. If you are not the Account Holder but you control the means of payment for a Paid Service account and wish to make any change to the payment method, you must notify us by contacting Customer Support and demonstrating to our satisfaction your control of the payment method used for the Paid Service.
If your credit card expires or the information is otherwise invalid, or you or another party controlling the payment method make changes to your billing account too close in time to when we charge for any Paid Service subscription (so we cannot reasonably act on your changes prior to billing), we will probably not be aware of this, and we will bill the current charges to the card we had on record; the continuation of your Paid Service subscription constitutes your authorization for us to do so, and you remain responsible for any uncollected amounts and any charges incurred by you or us as a result of billing to an invalid card.

Costs of Collection; Credit Card Chargebacks

In addition to the published fees for a Paid Service, you agree to pay any reasonable costs we incur to collect any unpaid or past due amounts, including reasonable attorneys’ fees and other associated costs. Delinquent payments will bear interest at the rate of 1% per month or the highest rate permitted under applicable law, whichever is less, from the payment due date until paid in full. If you purchase a Paid Service subscription with a credit card and then subsequently request your credit card issuer to reverse that payment, PicWish is charged a fee that may be a significant multiple of the amount we initially received. Accordingly, in order to enable you to pay relatively minor fees with a credit card, you acknowledge and agree that we reserve the right to suspend your ability to add additional Content to your PicWish service account until such time as you reimburse us the amount of the fee we were charged by the card issuer.

Who Am I Contracting With?

If you purchase a Paid Service from us, you will be entering into a contract with one of several PicWish affiliated companies, based upon your geographical location. Those provisions regarding contracting parties and governing law continue to apply to our contracts for the PicWish Service and if you acquire or redeem an Activation Code/Coupon Code. If you elect to pay a third-party reseller or payment processing firm for any Paid Service, the contract regarding your payment will be with such third-party, but such third-party is not authorized to provide you with any contract terms or other assurances that affect PicWish’s obligations relating to our delivery of the Paid Service; our obligations to you are governed by the Terms of Service, Privacy Policy, and these Payment Terms.

How to Get a Refund?

We are committed to providing the best product experience and service to all our users. Before purchasing, you have a free version to test the functions. If you are not satisfied with the purchased services, you can get a full refund under our approved conditions.

PicWish provides 7 days money-back guarantee for annual/monthly subscriptions and 3 days money-back guarantee for weekly subscriptions.

Desktop (Windows only): Within 7 days, we will refund the remaining credits in your account based on the unit price of the credits at the time of purchase. For example, if you purchase the monthly plan for 1000 credits, we will refund the remaining credits at $0.02/credit. If you purchase a permanent package of 1000 credits, we will refund the remaining points at $0.04/credit.

API: Within 7 days, we will refund the remaining credits in your account based on the unit price of the credits at the time of purchase.

If it is more than 7 days since the purchase, please contact our customer service with a reasonable description for processing the refund.

These reasons include:

  • Compatibility issues between our app and the customer’s hardware, which cannot be resolved by our technical department.
  • Other major technical problems that cannot be resolved within 7 days of purchase.
  • Incorrect purchases and requests for replacement with other products from our product list.
  • Repetitive purchases due to platform errors.
  • The product does not function as described on the product page or advertisements.
  • Even after contacting our support center, the account cannot be activated.

Special cases where refunds are not supported:

Orders purchased through third-party platforms such as App Store and Google Play cannot be refunded directly by our company. Customers must contact the platform to process the refund.

For orders purchased through the App Store and Google Play, the platforms will charge a 30% fee. You can refer to the refund policy of App Store and Google Play to apply for a full refund. If the refund request is rejected, please send us the proof of refusal and we will process a refund for 70% of the order.

To apply for a refund, please submit a ticket. Once the refund is processed, the corresponding membership will be invalid.

Dispute Resolution

The interpretation and dispute resolution of this privacy policy shall be governed by the laws of the mainland of the People’s Republic of China. If any disputes arise from this agreement, the parties shall make every effort to resolve them through friendly negotiation. If negotiation fails, you agree to submit the dispute to the Hong Kong International Arbitration Center (HKIAC) in accordance with its arbitration rules. The arbitration The award shall be final and binding on all parties to the dispute. If the arbitral tribunal rules that any provision or any part of these terms is unenforceable, the remaining provisions or parts of these terms shall remain fully effective. If you believe that our processing of personal information If the behavior harms your legitimate rights and interests, you may also choose to report it to the relevant government departments.

Attachment 1: Auto-renewal Subscription

  • PicWish Auto-renewal Subscription is a service provided to you for the purpose of automatic renewal to avoid failure to renew in time due to negligence or other reasons, provided that you have activated the monthly credit service.
  • If you activate this service, you are deemed to authorize the Auto-renewal Subscription service to deduct the fees for the next cycle from your own account or other third-party payment account when the service period is about to expire.
  • The premise for the implementation of this service is that you have bound your PicWish account to the above account and can successfully deduct the full amount from the above account. For the selected payment channel, you are obliged to regularly pay attention to it and ensure that there is sufficient balance under the account of the payment method to meet the application of the automatic renewal service. If the application of the automatic renewal service cannot be met due to the above-mentioned defects (including but not limited to: insufficient balance), PicWish has the right to suspend or terminate your monthly credit service without further notice.
  • If you choose to cancel the automatic renewal service, you need to cancel the subscription at least 24 hours before the end of the expiration period, otherwise the system will still automatically renew the monthly credits for the next billing cycle. You acknowledge and agree that there may be a delay in the automatic renewal status, which is subject to the number of your credits displayed in the PicWish app. Before you successfully cancel, the deduction instructions that have been entrusted to PicWish for automatic renewal remain valid, and PicWish will not refund or compensate for the fees that have been deducted based on the instructions before the cancellation operation is completed.
  • You acknowledge and agree that if you use a third-party payment channel to pay for fees, you will also be subject to the third-party service terms and usage rules.
  • This service is valid for a long time from the date of your activation until you choose to cancel this service.
  • You can choose whether to cancel this service. If you do not cancel, it is deemed that you agree that PicWish will attempt to renew the deduction according to these rules. Once the deduction is successful, PicWish will add the corresponding credits for you (you can view the number of credits in the account interface in the PicWish app).

Cancellation of Subscriptions

You may elect to cancel a Paid Service at any time. Any cancellation of a Paid Service will be effective as of the end of the then-current billing period and subject to our Refund Policy, except as described below for an upgrade in Paid Service.

If you purchase from our website, you can contact the Customer Support to cancel auto-renewal.

  • After the cancellation of this service is successful, your monthly credits that have been successfully deducted and effective will not be affected, and the effective credits will not be automatically renewed after expiration. Before you choose to terminate this service, the behavior of entrusting PicWish to automatically renew the deduction is still valid. PicWish will not refund the fees deducted due to your entrustment. If there are adverse consequences, you will bear the relevant responsibilities.
  • PicWish has the right to adjust the term, price and related content of the existing members’ continuous monthly subscription according to user needs, changes in products and service content, etc., in order to continuously improve and optimize the service. If you have any questions about the content of this agreement, you can send an email to [email protected].
  • PicWish may modify this agreement due to business needs, laws and regulations (modification includes changing, adding, and reducing the corresponding terms and contents). However, once this agreement is modified, PicWish will publish it through system prompts/or information push/or announcements, etc. Please be sure to read the modified terms carefully. If you have any questions about the changes to this Agreement, you can stop using this service and consult customer service to better protect your rights. At the same time, you should be reminded that the updated Agreement will take effect from the date the updated version is released. If you continue to use the membership service, it will be deemed that you have agreed to all the changes. The updated agreement will take effect from the date the first article is updated.
  • The titles of all clauses in this Agreement are only for the convenience of reading and understanding, and have no actual legal meaning in themselves, and cannot be used as the basis for interpreting any clause or wording of this Agreement.
  • If any clause in this Agreement is invalid or cannot be performed for any reason, it will not affect the validity of the remaining clauses, and the remaining clauses are legally binding on both parties to this Agreement.
  • Please note that PicWish supports the standard Apple Licensed Application End User License Agreement (EULA).
